Forms and instructions for agencies

Agencies transferring Capital Postconviction Public Records to the Capital Postconviction Public Records Repository at the State Archives must follow these instructions and complete a Transmittal/Receipt form before sending us these records.  

Information for attorneys

Upon request, the Repository will provide attorneys representing death row inmates with copies of requested records in our custody.

About the Repository

The Repository was established within the State Archives in October 1998, as a central records repository for Capital Postconviction Public Records.

The Repository receives, maintains and indexes the copies of records submitted to us by law enforcement, investigative or other agencies having custody of records relating to capital cases and provides copies of those submissions to attorneys representing death row inmates upon request.

Records submitted under seal (as confidential and/or exempt from public disclosure) can only be opened for inspection by the trial court. The Repository will ship such records to the court upon receipt of an appropriate court order.  

The Repository operates under Section 27.7081, Florida Statutes, Capital postconviction public records production, and Rules 3.852 and 3.993, Florida Rules of Criminal Procedure (PDF).
